Terms of Service

1. The service

Super NotePilot is an on-device dictation, transcription and notetaking application. Speech is transcribed locally by Whisper and notes are processed locally by Google’s Gemma model. The App runs entirely on your device; we do not host your content.

2. Licence and permitted use

We grant you a personal, worldwide, non-exclusive, non-transferable and revocable licence to install and use the App for your own personal or internal business productivity purposes, subject to these Terms. The App is currently provided free of charge and without an account.

You may not reverse engineer, decompile, resell, sublicense or redistribute the App except where such restrictions are prohibited by mandatory law, and you may not use it in violation of any applicable law.

3. Your content and responsibility

You retain all rights to the recordings, transcripts and notes you create with the App. Because everything is processed and stored on your device, you are solely responsible for your content, for keeping your own backups, and for ensuring that you are entitled to record and process any audio (for example, obtaining consent from meeting participants where the law requires it).

4. Acceptable use and AI model rules

The App uses Google’s Gemma model on your device. Your use of Gemma is governed by the Gemma Terms of Use and the Generative AI Prohibited Use Policy, which we are required to pass through to you. Among other things, you may not use the model to:

• engage in dangerous or illegal activities, including child sexual abuse or exploitation, terrorism or violent extremism, non-consensual intimate imagery, or facilitating self-harm;
• violate the rights of others, including privacy and intellectual-property rights;
• compromise security — for example by generating spam, phishing or malware, or circumventing safety filters;
• generate sexually explicit, violent, hateful, harassing or otherwise harmful content;
• spread misinformation or misrepresent content, including impersonating others or deceptively passing off AI-generated content as solely human-made.

5. Third-party components and trademarks

The App incorporates open-source and third-party components, each under its own licence (available in the App’s “About / Licenses” section). Gemma and Google AI Edge are trademarks of Google LLC; Whisper is a trademark of OpenAI. Super NotePilot is an independent product and is not endorsed by or affiliated with Google or OpenAI.

6. AI output disclaimer

Transcripts and AI-generated text may contain errors, omissions or inaccuracies. Output is provided for your convenience and does not constitute professional advice (legal, medical, financial or otherwise). Always review AI output before relying on it.

7. No warranty

To the extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that transcription will achieve any particular accuracy.

8. Limitation of liability

We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, and where mandatory law (such as product-liability law) so provides.

For slightly negligent breaches of an essential contractual obligation (an obligation whose fulfilment makes proper performance possible and on which you may reasonably rely), our liability is limited to the foreseeable, typical damage. Any further liability is excluded. As the App is provided free of charge and processes your data only on your own device, we are in particular not liable for loss of data or content that you could have prevented with reasonable backups.

9. Availability and changes

We may update, change or discontinue the App, and may amend these Terms where there is a valid reason (for example new features, or changes in the law). The current version is always published on this page; your continued use after changes take effect constitutes acceptance.

10. Term and termination

These Terms apply for as long as you use the App. You may end them at any time by ceasing to use and uninstalling the App, which removes its local data from your device.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected. Where permitted by law, the place of jurisdiction is Kempten (Allgäu), Germany.

12. Severability and contact

Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
